Limited Warranty Deed

In Hawaii, a Limited Warranty Deed, also known as a Special Warranty Deed, is a Deed that conveys ownership interest in Real Property, statutory in nature, and requires the word “GRANT”, to implicate certain limited warranties or assurances from the Grantor and it’s ownership period: (1) that prior to the signing of the Deed, the Grantor has not conveyed the same property or any of the Grantor’s ownership interest of the property, to any other person or entity, other than the Grantee; and (2) that the property or the Grantor’s ownership interest in the property, being conveyed to the Grantee, is free from any encumbrances made by the Grantor.
