HOW THIS PROCESS WORKS IN HAWAII

If you and your spouse can agree on all the relevant issues, including but not limited to, the division of marital assets and debts, spousal support or alimony, and children custody and visitation issues, then our office could assist you in proceeding with the Hawaii Family Court’s uncontested divorce process. 

WHAT IS AN UNCONTESTED DIVORCE?

An Uncontested Divorce is when both the husband and wife can agree on all the relevant issues of the divorce and have settled all matters between. After all documents of the Uncontested Divorce Affidavit Packet are mutually signed, notarized, and properly filed with the court, it usually takes around 6 to 10 weeks for it to be reviewed by a judge. The divorce is only effective after the Divorce Decree has been approved and signed by the judge, and the Divorce Decree has been filed-stamped by the court.

In Hawaii, to obtain an uncontested divorce, both spouses must reach a settlement agreement on several key matters including, but not limited to:

1. Division of Property and Debts: Decide how to fairly divide all the marital assets and liabilities.

2. Spousal Support (Alimony): Determine whether one spouse will provide financial support to the other spouse.

3. Child Custody and Visitation: If there are minor children, agree on legal and physical custody arrangements, as well as a visitation schedule.

4. Child Support: Establish the financial responsibilities of each spouse to financially support the needs of the children.

An uncontested divorce can be less stressful, less costly, less time consuming, and be easier on any children involved. If disagreements arise between the parties, then the uncontested divorce could be changed into a contested divorce, which would be an expensive, time consuming, stressful and burdensome for both of the parties, and the now contested divorce would be heard and decided on by a judge.
