In Hawaii, a Timeshare Deed, is a Deed that usually conveys the Grantor’s right, title, and interest in and to the property, annually, and for a specific period of time, along with among other things:
(1) a vacation ownership interest, interval, or use period of the property;
(2) rights and privileges that pertain or otherwise go with the property; and
(3) all of the rights of the Grantor in the property.
In most cases, the property is usually subject to the documents which created and which govern the the Condominium Project (the “Condominium Documents”) or Ownership Plan (the “Plan”), and the documents which created and which govern the Vacation Ownership Plan (the “vacation plan documents”), or the Project (the “Project Documents”).
Timeshare Deeds are usually recorded in the Bureau of Conveyances for the State of Hawaii.
