Mediation is a potential dispute resolution solution, performed by a neutral third party, between two or more parties in confidence, for the purpose of reaching a mutually acceptable solution to a disagreement. This process is usually voluntary, but also may be required in the event of a breach of contract, as the first obligated step, before either Arbitration, or Litigation proceeds. Mediation is the preferred way to initially attempt to resolve disputes between parties, as it only involves the advisement by a neutral third party Mediator, and unlike Arbitration or Litigation, Mediation does not render a final decision by a Judge or Arbitrator, nor does that decision become a court order.
